Welcome to Captain Clowers Charters & Guide Service. By booking a trip, accessing

our website, or using any of our services, you agree to the following Terms & Conditions. Please read them

carefully before continuing.

1. Acceptance of Terms

By using captainclowers.com, communicating with us, or booking a fishing charter, you acknowledge that you have read, understood, and agreed to these Terms & Conditions and our Privacy Policy.

2. Service Disclaimer

Captain Clowers Charters provides guided fishing trips and charter services on the waters of San Diego, California.

  • Fishing is a natural, unpredictable activity. Catch results and conditions cannot be guaranteed.

  • Weather, ocean conditions, and wildlife activity may affect the outcome of any trip.

  • All information on our website is for general guidance only and may change without notice.

  • Safety instructions provided by the captain and crew must be followed at all times.

3. Client Eligibility

To book or participate in a charter, clients must:

  • Be at least 18 years old (minors must be accompanied by a parent or legal guardian).

  • Be physically capable of participating in boating and fishing activities.

  • Disclose any medical conditions, limitations, or concerns prior to boarding.

  • Understand that the captain reserves the right to refuse service for safety concerns, intoxication, or non-compliance with rules.

4. Booking, Cancellations & Rescheduling

  • All trips require advance booking.

  • Cancellations or rescheduling requests must be made at least 72 hours before departure.

  • Cancellations made within 72 hours may result in forfeiture of deposit or full payment, depending on charter type.

  • No-shows are non-refundable.

  • If the captain cancels due to unsafe weather or mechanical issues, you may reschedule or receive a full refund.

5. Payments & Refunds

  • Payment or deposit is required at the time of booking.

  • We accept major credit/debit cards and other listed payment methods.

  • All charter sales are final.

  • Refunds are not issued for:

  • Seasickness

  • Failure to follow instructions

  • Lack of fish activity (catch is not guaranteed)

  • Personal schedule conflicts

6. Safety & Conduct

All passengers must:

  • Follow safety rules and captain’s directions at all times.

  • Wear safety equipment when instructed.

  • Avoid alcohol intoxication or unsafe behavior.

The captain reserves the right to terminate a trip early if a passenger’s behavior endangers the vessel, the crew, or themselves.

7. Gear, Equipment & Catch

  • Standard fishing equipment is provided unless otherwise stated.

  • Damage to rods, reels, or equipment caused by misuse may result in repair or replacement fees.

  • Catch limits follow California Department of Fish and Wildlife regulations.

  • Cleaning and bagging of fish may be offered as part of the trip package.

8. Website Use

By using our website, you agree not to:

  • Engage in unlawful activity or misuse of the site

  • Attempt to hack, scrape, or disrupt site functions

  • Reproduce content without permission

  • Injuries caused by failure to follow instructions

  • Undisclosed medical conditions

  • Seasickness

  • Loss or damage of personal items

All passengers may be required to sign a liability waiver before departure.

We collect personal information for booking, communication, and safety purposes.

  • Your information is not sold to third parties.

  • Data is protected according to our Privacy Policy.

11. Changes to Terms

Captain Clowers Charters & Guide Service may update these Terms & Conditions at any time. Updates take effect immediately upon posting.
